Preamble – Definition of Scope and Services

Whenever these Terms refer to the “services,” the “Server,” or the “Administration,” such references expressly and specifically mean the MuAwaY game and any other connected games, websites, forums, applications (including MuAwaY Gerenciador), and services, regardless of the platform or device used to access them.

Chapter I – Acceptance and Age of Majority

1.1. In strict compliance with the Digital Statute of Children and Adolescents (Lei nº 15.211/2025 – Brazilian Digital Statute of Children and Adolescents), access to, registration for, and use of the server, as well as the acquisition of virtual currency, are permitted EXCLUSIVELY to persons over 18 (eighteen) years of age with full civil capacity.

1.2. Registration by minors is strictly prohibited. The creation of an account constitutes an express declaration of legal age. Accounts identified as belonging to minors will be immediately banned and all data deleted, with no right to any retention of information or refund.

1.3. By registering an account, downloading the client, or accessing the game, the user fully agrees to all the clauses of this document. If the user disagrees, they must discontinue use immediately.

Chapter II – Subject Matter and Virtual Goods

2.1. The server grants the user a limited, personal, revocable, and non-transferable license to access the game.

2.2. The MuAwaY brand, comprising its name, logo, visual identity, and other associated assets, is a trademark duly registered with the competent authorities. Unauthorized use of the brand is strictly prohibited. Additionally, all characters, items, virtual currency, and account progression are the exclusive property of the server. The user does not acquire ownership of any digital asset, holding only the right of use while the account remains active and in good standing.

2.3. For all legal purposes, references to “virtual currency,” “virtual goods,” or “virtual balances” in these Terms expressly include, but are not limited to: Golds, GoldsWay’s, JcPoint’s and GoldsEvent’s.

2.4. The server operates on an “as is” basis. There is no guarantee of uninterrupted availability (100% uptime), and the environment is subject to maintenance, network outages, and restarts for the application of fixes.

Chapter III – Code of Conduct

3.1. The user undertakes to maintain civil conduct at all times. The use of offensive language, harassment, discrimination, xenophobia, or threats against other players or members of the administrative team is prohibited.

3.2. The use, development, or promotion of third-party programs (cheats, hacks, bots, unauthorized macros) that alter the game’s memory or grant unfair advantages is strictly prohibited.

3.3. The user is obligated to immediately report to the administrative team any bug, technical failure, or exploit identified on the server. Taking advantage of such anomalies for one’s own benefit or that of third parties is expressly prohibited. This prohibition covers, without restriction, any attempt at manipulation, duplication, or fraudulent alteration of game items, as well as any other practice that grants the user an improper or unfair advantage or that negatively affects the system’s economy and mechanics. The knowing exploitation of flaws is considered an extremely serious violation and will result in the permanent banning of the account.

3.4. The promotion of other servers, games, or commercial products within the server’s communication channels (global chat, forum, Discord) is forbidden.

Chapter IV – Trade, Transactions, and Authorized Resellers

4.1. As a general rule of the server, the purchase, sale, exchange, or trading of accounts, characters, items, or virtual currency for REAL MONEY, cryptocurrency, or physical goods between regular players is expressly prohibited.

4.2. The sole and strict exception to the rule described in item 4.1 is trading carried out by Authorized Resellers. These are partners officially accredited, vetted, and listed by the server’s administration. Only these representatives are authorized to trade items and virtual currency for real money directly with users, ensuring the provenance and security of the transaction.

4.3. The exchange of items within the game is permitted, but occurs at the user’s own risk. The server will not intervene in, or reverse, trades that go wrong due to inattention.

4.4. Any attempt at trading for real money carried out by players who are not Authorized Resellers, whether inside or outside the game (social media, messaging groups), is considered an extremely serious violation and subjects the offender to the maximum sanctions provided for in these Terms.

Chapter V – Account Security and Inactivity

5.1. The server provides and strongly recommends the use of advanced, free security tools, particularly Two-Factor Authentication (2FA) and the official MuAwaY Gerenciador application. Adopting these features provides an extra, substantial layer of security, drastically reducing the occurrence and likelihood of unauthorized access. However, the activation, management, and ongoing use of these protective technologies are the sole and exclusive responsibility of the account holder. The user is the sole guardian of the confidentiality of their login and password. The server emphasizes that it will never, under any circumstances, request any player’s password. Consequently, the Administration disclaims any liability and will not restore accounts, items, or virtual currency in cases of theft, intrusion, or loss resulting from carelessness, the sharing of credentials, or the user’s negligent failure to enable the security features (such as 2FA) offered by the platform.

5.2. For all purposes, the true owner of the account is the holder of the email address registered at the time of account creation.

5.3. To ensure database performance, accounts or characters inactive for more than 90 days may have their virtual currency balance and certain items removed. Accounts inactive for more than 180 days may be permanently deleted from the system.

Chapter VI – Contributions and Technical Support

6.1. The purchase of virtual currency or VIP packages on the website constitutes a contribution toward the maintenance of the server’s hosting and security infrastructure, granting the user a virtual balance in return.

6.2. If the account is blocked, suspended, or banned for violating these Terms, the user will immediately lose access to the account and its virtual goods, with no right to a refund, chargeback, or transfer of the amounts spent.

6.3. All technical support, reports, or requests must be submitted exclusively through the Ticket system on the user panel. Technical support is not provided via social media or direct messages within the game, unless expressly indicated otherwise.

6.4. In compliance with Article 49 of the Código de Defesa do Consumidor (Brazilian Consumer Protection Code), the user is guaranteed the right of withdrawal from purchases made, within a period of 7 (seven) days. However, the user understands and expressly agrees that virtual currency and VIP packages are consumable digital content in nature. From the moment the balance is credited to the account and used (spent in the game’s virtual store, activated, or transferred in any way), the service will be deemed fully rendered and consumed. Use of the digital benefit entails the waiver and forfeiture of the right of withdrawal, precluding any request for a chargeback or payment dispute with credit card issuers.

Chapter VII – Sanctions, Proportionality, and General Provisions

7.1. The server adopts a graduated system of sanctions, guided by reasonableness. Punishments will be applied progressively, taking into account the player’s history, recidivism, and the severity of the conduct.

7.2. Violations of the server’s rules are subject to the following progression of penalties:

• I - Warning and/or Muting: Applied to minor violations, such as initial inappropriate language, minor disagreements, or chat spam.
• II - Temporary Suspension: Preventive blocking of the account for set periods, applied in cases of moderate violations or repeated recurrence of minor violations.

7.3. The application of a permanent ban and account deletion, without the need for prior progression, will occur exclusively in cases of extremely serious violations that threaten the integrity of the server, other users, or the administration.

7.4. Any objection, defense, or appeal regarding suspensions must be submitted solely and exclusively by opening a Ticket with official support. Exceptionally, in cases of Permanent Ban, the appeal must be sent directly to the official email: suporte@muaway.net. The administrative team will review the appeal based on the user’s claims and the system’s internal records (logs), with the administration having the final decision on whether to uphold, reduce, or revoke the penalty.

7.5. In strict compliance with the Marco Civil da Internet (Lei nº 12.965/2014 – Brazilian Internet Civil Rights Framework) and the Lei Geral de Proteção de Dados Pessoais - LGPD (Lei nº 13.709/2018 – Brazilian General Data Protection Law), the server undertakes to cooperate fully with police authorities, judicial authorities, and investigative bodies. Registration information, connection records (IP logs), financial transaction history, and communications retained in the system may be provided to the competent authorities, without prior notice to the user, upon a court order or a reasoned legal request. This measure is intended to actively assist in combating cybercrime, fraud, violations of third-party rights, or infractions of the Estatuto da Criança e do Adolescente (ECA – Brazilian Statute of Children and Adolescents).

7.6. The server operates on a complex digital infrastructure subject to technological disruptions. The administration is not liable for indirect damages, loss of profits, or the deletion or loss of data in cases of force majeure (such as rollbacks or emergency database restoration to protect against critical failures). Additionally, the server is relieved of any civil liability for claims of moral damages, loss of valuable time, or frustration arising from temporary interruptions (maintenance and network outages), the application of penalties provided for in these Terms, or the eventual permanent shutdown of the server’s activities.

7.7. The server reserves the right to alter, modify, or update these Terms of Use at any time. Continued use of the service after notification or publication of changes constitutes tacit acceptance of the new document.
